Terms of Use
Weight Loss Intelligence, Powered by The Hoffman Cycle™

These terms are an agreement between you and WLI Health, Inc. ("WLI Health", "we", "us"), an Illinois corporation, for your use of the Weight Loss Intelligence app and the website thehoffmancycle.com (together, the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Not medical advice
The Service is a wellness tool. It helps you track and understand your weight over time. It is not a medical device and does not diagnose, treat, cure or prevent any disease or condition. Nothing in the Service is medical advice, and using it does not create a doctor-patient relationship.
Always talk with your doctor or other qualified health professional about your health, your weight, your medication and any changes to them. Never disregard professional advice or delay seeking it because of something you saw in the Service. If you think you may have a medical emergency, call 911 or your doctor right away.
2. Predictions are estimates
The Service shows patterns, predictions and estimates based on the readings you provide. They are estimates, not promises. Your results depend on many things outside our knowledge, including the accuracy and regularity of your readings. Past patterns may not continue, and individual results vary.
3. Who can use the Service
You must be 18 or older and live in the United States. You must give accurate information when you sign up, keep your sign-in secure, and tell us if you think someone else has used your account. You are responsible for activity on your account.
4. Your information
Our Privacy Policy explains what information we collect and how we use and protect it. You keep ownership of the information you provide. You give WLI Health permission to store, process and analyze it to run the Service for you and to improve it, as the Privacy Policy describes. You can delete your account and your information at any time from the Account tab.
5. Connected services
You can choose to connect services such as Withings, Apple Health or Health Connect. Those services are run by other companies under their own terms, and we are not responsible for them. We read only the information you allow, and you can disconnect them at any time.
6. Acceptable use
You agree not to:
- use the Service for anyone but yourself, or enter someone else's information without their permission;
- copy, modify, reverse engineer or try to extract the source code or methods of the Service, except where the law allows it;
- interfere with or disrupt the Service, or try to reach information that is not yours;
- use the Service for any unlawful purpose.
7. Our intellectual property
The Service, including its software, design, methods and content, belongs to WLI Health and its licensors and is protected by law. The Hoffman Cycle™ is a trademark of Daniel V. Hoffman, used under license. We give you a personal, non-exclusive, non-transferable right to use the Service for your own, non-commercial purposes while these terms are in effect.
If you send us ideas or feedback, we may use them without any obligation to you.
8. Fees
The Service is currently free. If we offer paid features later, we will show their price and terms before you buy. Purchases made through the App Store or Google Play are handled by Apple or Google under their terms.
9. Changes and ending the Service
We may update or change the Service, or stop offering it. You can stop using the Service and delete your account at any time. We may suspend or end your access if you break these terms or if we must to comply with the law. Sections 1, 2, 7 and 10 to 13 continue after your access ends.
10. Disclaimer
The Service is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that the Service will be uninterrupted, error-free or that any result will be achieved.
11. Limitation of liability
To the fullest extent the law allows, WLI Health and its officers, directors and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some states do not allow these limits, so they may not fully apply to you.
12. Indemnity
You agree to defend and hold WLI Health harmless from claims arising from your misuse of the Service or your breach of these terms.
13. Disputes
These terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law rules.
Please contact us first at support@thehoffmancycle.com so we can try to resolve any dispute informally. If we cannot resolve it within 60 days, any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. You and WLI Health each give up the right to a jury trial and to take part in a class action or class arbitration. Either of us may instead bring an individual claim in small claims court. You may opt out of this arbitration agreement by emailing us within 30 days of first accepting these terms.
14. App Store terms
If you downloaded the app from the Apple App Store:
- These terms are between you and WLI Health only, not Apple. WLI Health, not Apple, is responsible for the app and its content.
- Your license is limited to using the app on Apple devices you own or control, as the App Store terms permit.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the app.
- WLI Health, not Apple, is responsible for any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, and claims that the app infringes someone's intellectual property.
- You confirm that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you downloaded the app from Google Play, Google's terms for Google Play also apply.
15. Changes to these terms
We may update these terms. We will post the new version here with its effective date and, for significant changes, notify you in the app. If you keep using the Service after a change takes effect, you accept the updated terms.
